These terms and conditions outline the rules and regulations for the use of https://snpeellie.com/'s Website, located at https://snpeellie.com.

This Agreement is entered into by and between Elham/Ellie Kazemi (hereinafter referred to as "Posture Coach") and the undersigned client (hereinafter referred to as "Client") for the purpose of providing Posture Correction Classes by the Posture Coach to the Client. These classes may be conducted either online or in person, as agreed upon by both parties. Client’s use of any premises, facilities, equipment, or digital platforms is contingent upon this Agreement.

It is understood that these classes are not a substitute for medical treatment or therapy, and the Posture Coach does not provide medical services. The Client should consult a healthcare professional for any medical concerns.

RISK ASSUMPTION:

The Client acknowledges and agrees that engaging in any physical fitness activities, including but not limited to Posture Correction Classes, can be strenuous and may involve inherent risks of serious injury or harm. These risks include, but are not limited to, injuries resulting from the use or misuse of equipment or facilities, participation in activities, or accidents occurring on the premises.

By participating in any program, activity, event, or instruction—whether or not part of the Posture Coach's fitness, sports, or recreational offerings—the Client voluntarily assumes full responsibility for all risks and potential injuries or damages.

The Client further agrees that the Posture Coach or any affiliated parties shall not be held liable for any injuries, damages, or losses incurred during participation. This includes, but is not limited to:

Injuries resulting from the use or misuse of equipment or facilities.
Accidents occurring on the premises.
Injuries resulting from the negligence of the Posture Coach.
The Client affirms that they are voluntarily engaging in these activities and programs with full knowledge of the risks involved.

RELEASE:
Client agrees to release, waive, discharge, and hold harmless the Posture Coach, including the Posture Coach's affiliates, employees, agents, representatives, successors, and assigns, from any and all claims, demands, or causes of action, including but not limited to those arising from injuries, accidents, or damages that may occur during or as a result of participation in posture correction classes. This includes claims related to travel associated with the classes, the use of any equipment or facilities provided by the Posture Coach, or claims arising from the negligence of the Posture Coach. The Client assumes full responsibility for any risks, losses, or liabilities associated with their participation.

SEPARABILITY:

The Parties acknowledge and agree that each provision of this Agreement is intended to be read and construed independently from the others. If any provision of this Agreement is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.

GOVERNING LAW:

This Agreement shall be governed by, and construed in accordance with, the laws of the State of California, without regard to its conflict of laws provisions.

ACKNOWLEDGEMENT:

By signing this Agreement, Client acknowledges that he/she has carefully read this waiver and fully understands the content hereto. Client submits voluntarily and was not threatened, intimidated, or was under in any form of duress, representations or inducement.
